Divorce Proceedings
There is only one ground for divorce. The Court must be satisfied that there has been an irretrievable breakdown of the marriage. This can be demonstrated on one of five ways

Adultery
This is a basis to bring divorce proceedings if the Respondent has committed adultery. It is no-longer necessary to name the other person.

Unreasonable Behaviour
This reason can be used if the Applicant can evidence that as a result of the Respondent’s behaviour they can no-longer live with them.

Dessertion
This is the situation where the Respondent leaves and is not heard from. This is rarely used and requires a period of desertion in excess of two years.

Two Years Separation with Consent
If the parties have been separated for more than two years and both agree to the divorce this basis can be used.

Five Years Separation
Once parties have been separated for more than five years an application can be made for divorce without the consent of the Respondent being needed.
